Does anyoe know what I can do if my sons father is witholding his employer information, so I cannot inform FOC. According to Michigan law, and employer is supposed to notify the state of new hirees no more than 20 days after hiring. He has been employed for 8 weeks. Everytime I call the FOC to find out if they have any new employer on file, they tell me that their data report shows his old employer from 4 months ago. I've emailed people in charge of child support regarding my situation and if there is a way that I can turn in his company for not following Michigan law, but now one has replied. The FOC doesn't seem to care either!

Thing is....I have absolutly no idea where he works either. He claimed 3 weeks ago he would give me the info, then said he was waiting for his employer to put him on afternoons, then claimed he would just send the payments in himself. All of which has not happened. My family has suggested waiting for him to leave work and follow him, but he parks in a parking lot behind his mothers house and waiting for him to leave in the morning would require I park on a big and busy road where parking isnt permitted. He's a shady character. His girlfriend lives in the same apartment complex i do, about 25 feet from me actually and hes over there all the time. Hes only acknowledged his son twice in the past 4 months, and hes visiting his girlfriend EVERYDAY!!!

JJ...I do know the routine, I have been dealing with this for 9 years. He has been in and out of jail and got out in April. Yes there is a court order for support. I have provided a link for info on the Michigan New Hire, its not for taxes.
http://www.michigan.gov/dhs/0,1607,7-124-5439-20558--,00.html

This new hiree system helps FOC locate a non paying parent and has worked beautifully in the past, but when an employer doesn't report a new hire, the FOC cannot obtain the info to send the income withholding notice to the employer. Having to go down to the court everytime there is an issue is, Im sure a hassle for most and this new system the State of Michigan has began eliminates that hassle.

The one thing that you did not mention is: is he under a court order to pay child support?. if he is, it is his obligation to notify FOC of change of employment or unemloyment.
The, FOC sends his employer a court order, and then the employer has to garnish his wages.
Which has to be renewed every 90 days
I have been through this myself and ths is what I had to do, I myself live in Michigan and somewhat familer with this.
I suggest to you is to contact the FOC again and request a hearing, for him to come in and talk to someone, I usually had to talk to a referee and let them know where I lived and who my employer was, if any.
And what you stated about and employer is supposed to notify the state of new hirees no more than 20 days after hiring...
That is just for taxes and social security.
I hope this helps.
Good Luck

If your case is not up for a review than I don't think they would care unless you are not getting any money. In that case it takes thirty days of non payment and at that point the father only has to pay about ten dollars a month until he catches up.

You can file for a review every three years. If you have not had a review in three years you can request one. The FOC will send you a questionnaire about your employer and his.

write a letter with information given and send it through the mail. Save a copy for your files. If nothing happens then call and ask to speak to your caseworker's Supervisor.
