My car was rear-ended while disabled and both of the drivers were given citations. I just tried to get insurance and upon checking this MVR report, the state is considering me to be at-fault!!
How do I contest this and have the mvr report changed so that im considered not at-fault?

Double check with the insurance company!! In most all states, any accident will come back with an accident code of 000. This means that the person reading the report has no idea if you were at fault or not. If you were at fault, then they need to manually input 002 - at fault accident. If you were NOT at fault, then they need to manually input 004 - not at fault. In the latter case, you WILL need to take something with you to show you weren't at fault. An accident report or letter from your previous carrier showing that they didn't pay anything out will work.

Most insurance agents don't even think of this, but when they look at your MVR, if it shows an accident date, it should also show a violation date. If there are two dates (one for acc, and one for vio.) then it means that you did recieve a ticket. If there aren't, then you most likely did not.

PS. To the first person who answered - Even if the car is disabled, the people who hit him should have been paying attention. If it were a five year old standing in the middle of the road, and they hit the child, they would still be at fault. Same theory applies to disabled vehicles.

Ok, are you sure we're talking about the same thing? The MVR report should onlly list your tickets, not whether you were at fault for the accident. That would show up on a CLUE report. And if that's what's happening you need to call your insurance company and ask them how they have handled the claim. Is it coded as at-fault and if so did they pay for damages? Sometimes, and I don't know why, the CLUE report gets info saying it's an at-fault loss when it isn't. When that happens you need to get a letter from them saying they have it listed as non-fault. You should be able to turn this over to whomever you need to.

If it's on the MVR report you can do the same thing, I think. The ticket is not the determining factor in who is legally liable for the accident, so ask a few more questions about where the info is coming from, then you may need to make some phone calls.

All states have a clause that if you are involved in an accident (single vehicle or not} you are required to report that accident to DMV. Now the lower cap in every state is different, but if the other driver reported the incident and you did not you can find yourself in trouble..
