My soon to be 13 year old niece is living with my parents as her mother isn't quite fit (considering she is on parole now, has left her in my parents care for about 2/3 of her life anyway, is pregnant with her lover's child and when she did have her daughter with her, her husband abused her).

Now, should something happen to my parents (very possible as they are in poor health), could I fight to get custody of my niece?

Here are her possible guardians:

Her dad who has not had a job last more than 2 weeks at a time. He is 35 and just recently moved out of his parent's house to go start a band in Nevada. He has a history of drug use.

Her paternal grandparents which take her on the weekends for visits. All their kids and grandkids (except my niece and now her father) live with them and all have a history of drug use.

Me, her 19 year old college aunt. No drug/alcohol use. Has own apartment.

Her uncle: drug use history and shares house with two families.

talk to Ur mum and dad to work out what should happin to u niece if the cast they had pass I'm sure u can get paper work to say that ur mum and dad think its in the best inters of ur niece to be place in ur care in the case of there poor heath or death

of course you have a chance. it's funny that i should see your question because i just went through something similar. my sister died. leaving her nine year old grandson. my niece, my sister's daughter has some mental illness. my sister has had custody of him since he was one and a half. i could have petition for guardianship but i thought to leave the child with my sister's common law husband of twenty-seven years. i also was caring for my mother at the time but she is now deceased. right now today he want allow me to talk with the kid. i miss him dearly. my sister was ignorant and now i find her man is ignorant too!. go for guardianship now. don't think about it long. if you think long, you think wrong. speak with your parents. have a back up plan in place. if you don't paternal grandparent will! and that does not sound healthy at all. some people do this for money, not love of! make your move before it's to late. give the kid a chance at least.

Of course you have a chance. You are the obvious candidate and if you can find it in your heart to take your niece in you may save her life.
