This guy abused my freind while she was pregnant. He aslo is a heavy drug user. He never once has seen the baby and wasnt there for the pregnancy. He is wanted by the authorities for skipping probation. Do you think that he should get rights to that baby

The courts are very reluctant to terminate the rights of parents. I have known women who have put the words unknown in the place of the father's name on the birth certificate to avoid giving the abusive father a way of having contact. That said,since he has not had contact as of yet, in order to force contact he would have to go to court and get an order for visitation,and if she can document his abuse and his drug arrests ,then she can ask for supervised visitation,which would take place with a state worker present.Also as part of his visits he would have to be screened for drug use on a regular basis,and take part in parenting classes,or go to a councilor. There are many hoops that he can be made to jump through-besides having to pay child-support. Is this jerk the type who will be able to jump through all of the hoops ??? If not then she should stop worrying. If challenged about not encouraging contact the phrase is "I acted in the best interests of the child."

No he doesn't have rights's of the baby and the fact is she has to take him to court to get this situation handled by the court and make sure that she tells the judge that he is a heavy drug user , the abuse, he wasn't there for the baby , he wasn't there while she was giving birth and just taking him to court they will run his name in the computers and see that he is wanted and skipping probation....Good Luck

No, absolutely not! I hope your friend is documenting everything he's done. And she should make sure she's not even trying to get any kind of monetary support from him. Often when women pursue child support, that's when the man will decide he wants to be a part of the baby's life. I know that sounds like a sucky thing to say, she's entitled to child support, but to protect herself and her baby it might just be best to let that go.

if he is as bad as you say all you have to do is file saome kind of motion to terminate his parental rights. If he is using drugs he most likely will not show up to the hearing and therefore will lose rights. But then he will also lose his obligation to pay child support. If the mother wants child support she may sue him and she would probably get it and she could still control if he sees the baby or not.

No, I don't believe he should have any rights and for the sake of her safety and the child's well-being she needs to leave the area with no forwarding address.

Whether the law would agree or not on Father's rights is something I can't answer.

Am I the only guy answering this question?Anyways NO he shouldnt if he can't respect the mother and he abused her can you imagine what he could do to the baby?

absoultly not. if you or she knows were he is at call the police. also she should sue for child support and full cusstdy of the child. a person like that is not a man and less then human.
