My Dad was blind. He was crossing the street at a crosswalk when he was hit and killed by a speeding car. The driver didn't have a license or insurance. He hit him so hard it threw all of his clothesoff him and threw him 8feet in the air and landed 25 feet away. The police won't do anything cause they say that my Dad walked against the light. The driver is still driving today. He should of never been behind the wheel. He also refused to take a chemical test. We're trying to find a lawyer to help us.

We live in Indiana. We tried some lawyers they won't touch the case cause the driver has no insurance. So they can't get paid they want their money.

In my state, ANY PEDESTRIAN HAS THE RIGHT OF WAY ANYWHERE THEY ARE AT..sidewalk, street, middle of street, etc.
There is, of course, "contributing negligence" but that is for the COURT to decide.
Call a lawyer, any lawyer...try legal aid first

I'm so sorry for your loss. That is terrible what happened. It's really disgusting how the police handled the situation. Even if he was crossing when he shouldn't have been, I don't believe that allows the driver to get away with murder, especially if he was driving recklessly by speeding and no insurance. All I can say is I hope it is on his conscience for the rest of his life. I hope you find the lawyer you need and that guy gets what he deserves!

Oh MY GOD that's terrible. The police took a horrible attitude too. I'm willing to bet there are plenty of lawyers who would LOVE this case, especially if you can provide proof that your father was blind and proof about the driver. My gosh, even if he wasn't blind the guy should have been prosecuted for manslaughter at least. What a miscarriage of justice. Look in the yellow pages for lawyers that deal in wrongful death. Wow, I'm sorry to hear about your situation. I would do a search and see if you can find a "blind" lawyer. I'm sure there are many of them that can help or at least a lawyer the helps people with disabilities.

Remember, that driver will get what he has coming to him. Eventually. It won't bring your father back if you have him charged and sit him in a cell. Let Carma take care of that ***.

Some states will take into account the actions of a person when they are injured, but still, you should find a lawyer through the American Bar Association, they will be MORE than happy to refer you.

Pedestrian always has the right of way and if Indiana is like MN your dads insurance will pay the bills

sorrry to hear about ur dad. I dont know any decent lawyers especially around ur area cos u aint told us wat area ur livin in! but anyways just wanted to say sorry.
