I live in Virginia. And I'm looking for a new charge, currently I am pending trial for an assult that was charged against me, but I dont have court for another 2 months, and I'm not convicted of it yet, so it should not be on my record. My question to you all is....

When Applying for the job, When they run the backround check will it show up only my current history, or will is show up my pending charge, even though im not convicted of it yet?

Because I want the job but I don't want to have to put down I am pending an assult charge, when more then likely im not even going to get convicted of it? so what do u guys think? will the backround check show a pending court date? or only current convictions, thanks!

When they run a background check, all that will show up are your convictions.

I encountered the same situation when applying for my most recent job (although I was still in the same town, and had worked for the newspaper previously, and so there was a small story regarding my pending charges - nothing to do with my position). Most employers knew my background, since it had been published. For most positions, you would not include any pending charges and if it's misdemeanor assault, for several you wouldn't have to include even if convicted. In most instances, it is clear on employment applications what an employer requests (whether anything, even pending, or not). I went for several interviews, many with people who I knew were aware of my pending charges, and I didn't feel that the issue affect my future employment chances in any way (although the charge was providing alcohol to a minor). Basically, if they don't ask (specifically) and you don't tell, then I don't believe employers would hold it against you, even if they became aware later of the situation. I think they want to know only the information specifically requested.

When you signed the consent for them to run a background check, did the question ask: Have you ever been convicted of a felony? OR did it ask have you ever been charged with a felony? If it was the first question, then you would be truthful in saying NO. You are correct that it will not show up on your background check, unless they run a local check showing charges. I do both for my company. If it is not a felony crime, then it should not matter to them.

I don't think you can avoid mentioning it or they will think you are a weasel when the background check shows it.
Tell them in a way that puts the best light on it. "I was erroneously accused of an assault and am expecting to be cleared of those false charges shortly. In the interest of being honest with you I have to mention that."

I'm in TX, and here the charges don't show up on your records until you convicted. Go for the job now unless you think you're going to jail for assault. Don't mention it on your app. All they ask is if you've ever been CONVICTED OF A FELONY, from what I remember. I don't believe assault is a felony, unless you killed someone. Good luck.

Argue that you did not mean to give the Employer false information, but you are not guilt or even convicted, so you did not think you had to put it down, or play innocent.
You need a lawyer to advice you, not just the court appointed Lawyer. One that knows Military Law and military attitudes.

Not usually unless you have to pass a background check for a specific security sensitive job... Admit nothing, deny everything, demand proof...

does the application ask if you currently have any charges pending against you? if so, then the answer would be "yes"......if the question you encounter relates to convictions, then the truthful answer now would be "no".
