I had an occurance the other night where some guy I did not know was trying to break into my house by kicking in the door.. He was trying to get to a girl that was there, that I also did not know. I believe that he had every intent to beat her if not kill her. I called 911 and then took a defensive position in the middle of the living room with an oak staff, waiting for him to get through. I have since secured a pump shot gun in case he decides to come back, since he now knows were I live.

Once inside your home, you can shoot the shi!t out of the piece of sh!t. HOWEVER, it will be up to you to prove the force was justifiable. They must be INSIDE the home. They can't be in your garage. They can't be outside messin with your car, they must be inside the home. It also GREATLY enhances your defense if you at least come up with a good reason as to why you didn't just go out the back door as well.

HOWEVER, you are in Texas. I'd dare the DA to find 12 jurors that would convict me! ;-)

McOff is correct. There used to be an old law on the books that dealt with cattle rustlers where you could kill someone on your property if you thought they were going to harm your livestock, it had been used as a defense for tresspassing a few times. I believe they either changed it or repealed in in the last few legislative sessions. Be aware though, that unless you are in immediate danger, there are laws against discharging a firearm inside city limits - no warning shots unless the guy is going to hurt you. Find out who he is and get a restraining order against him and press charges for destruction of property and tresspassing. The longer the paper trail the better. Tell your neighbors to watch for suspicious activity and look into an alarm that will call the police if triggered or get some security lights around the front of your house and a sign to put in the yard that says you have an alarm. And don't let girls you don't know into your house... It might not be a bad idea to watch your car for slashed tires either.

I don't know about texas, but you have the right to defend yourself in GA, and I would assume anywhere else in the U.S.A., but dont take my word on that...look online, or call the local police department and ask. You should report the incident to make record of it. You have a reasonable expectation to safety in your own home, and if you feel your life or well being is in jeopardy, then by all means defend yourself. Remember, center mass stops, headshots kill!

Definately report the earlier event if you have not already, and even ask the police department have an extra patrol in your neighborhood. Be careful, and good luck.

people here don't understand the law. Just because someone is in your home doesn't give you the automatic right to shoot.

Also you can shoot someone outside of your home! or in a public area!
You must justify that your life or someones else life is in imminent danger of serious physical harm. That's it, it does not matter where. Most states require a motion of a affirmative defense.
What that means is you are required by law to prove (on a unofficial scale of 51%, or higher) that the force was justified.

I lived in Texas about 15 years ago and I think that deadly force is acceptable once you have established imminent threat to you or someone elses life. But the intruder needs to be inside your residence for it to be considered justifiable.

We shoot them and make sure they're in the house when the cops come. A shotgun is a perfect home protection device. Load it with serious shot. Its good you filed a report, the police have a record now in case you have to shoot him.

Force needed to stop the crime.

Personally though, I would hope the intruder had a weapon that justified my shot at his leg that hit him right between the eyes.

if you have to shoot him inside your home cover tour butt, put the biggest kitchen knife you have in his hand after you have cleaned your prints off, or a Saturday night special. this is and old trick used by our boys in blue for many years. self defense no problem, just make sure the shooting is in you house.
