Yes, it can happen. My DUI had nothing to do with drugs, just alcohol, and when I showed up for probation I did not have to take a drug test. But, I've seen other people that had to. When I was sent to alcohol treatment (kind of like an AA), I did have to take drug tests there. I would be safe and quit now, because even if they don't drug test you, your probation officer has the right to do it at any time.

If the judge didn't mention drug testing, did they give you conditions of probation, such as remain law abiding, no drug or alcohol use, get treatment, no same or similar charges, ? Implied within the no drug or alcohol provision would be random UAs to add accountability to that requirement.

He can do anything he wants. That is why he is a judge. He probably knows that if you are on drugs you are more likely to be DUI again, even if you are not bright enough to know that.

A court can order a drug test if there is probable cause to believe tht you have been using drugs, and where that is relevant to some action pending before the court.
Laws vary by state. If you have specific legal questions, you should consult with a licensed attorney.

I don't know what State you are in and laws very slightly from State to State, but generally, once you are on probation your probation officer can drug test you and make random visits/searches of your place.

Not to be harsh but when you're convicted of DUI you become a suspicious character. Why? Because the best predictor of future behavior, is past behanior.

Yes.
In almost every state, random drug screens are part of probation.
If you fail it, it violates your probation.
By the way, I'm glad you got busted before you killed someone.
And, if you are concerned about a drug screen (that's called a hint) and obviously have a drinking problem, you should SERIOUSLY consider getting help.
If you don't, you are going to wind up killing someone.

Yes. It's called, "consequences for your actions."
Your conviction of DUI automatically makes you a suspect and provides probable cause for random drug and alcohol testing as long as you are on probation.
Suck it up and stop searching for trivial legal loop holes and be thankful you didn't maim or kill someone while DUI.
