My girlfriend missed a court date on 8-23 & just found out that there is a civil bench warrant for her. (It was a small claims court hearing in wisconsin). Will she be arrested? What should she do? Any advice would be helpful - thanks!

A bench warrant, civil or criminal, is a demand on the sheriff to apprehend and arrest the person named. If she's stopped for a simple traffic ticket, she could easily wind up in jail!

She should call the clerk of courts, and ask what she needs to do to vacate the warrant, and possibly she should contact an attorney as well. Most likely the warrant is for contempt of court, but obviously I can't be sure of that.

A bench warrant is issued when someone fails to appear in court when they were scheduled. Yes, your friend can be arrested, but it usually gets put on her record and she will be arrested when she gets a speeding ticket or has any other run-in with the police.

The best thing to do is to go to court and get the matter handled. If she goes to court, the ourt will reschedule the trial and as long as she shows up on that day, everything should be cleared.

Bench warrants are nasty things - the police don't necessarily come looking for your friend, but when they find her, they'll take her in.

It just means that she needs to turn herself in. She'll get a letter soon stating that she needs to come down to the station to be processed. They'll probably let her go immediately and reset a court date. But if she gets pulled over, they will arrest her. It's best to go straighten it all out.

she should call the magestrate and se if she can turn her self in without being arrested, if so go and he'll get you a court date. if not you will have to turn yourself in, if you are black they will probly make you pay a bond, if not they may let you go. She will only be arrested if a cop has reason to run her lisence, so tell her don't have any black dudes in her car anytime soon.
