My friend recently applied for a subsitute teaching job in Kentucky. She was required to take a blood test. She thinks they screen for blood diseases like HEP or HIV. I told her it was for drugs. The kind of testing she is talking about is illegal is it not?

I believe it depends on whether the employer has a license and permission by law. If they asked her if she was willing to take the blood test and she said "yes" this also gives them permission. They can not choose whether to hire her or not because she denies a blood test unless they have the laws permission to give the tests. You are right it was most likely a drug test. No one is allowed to test you for HEP or HIV except doctors. That would be considered an invasion of privacy. Hopefully those who do have these diseases are smart enough to listen to their Doctors and use the proper precautions.

It depends. Most private employers can do whatever screening they deem necessary for prospective employees, to be sure prospective employees are in compliance with company policy. Not sure if that includes publically funded organizations like school boards, etc. I've not heard of blood tests - generally urine tests are adequate for drug screens. Unless they are testing for Hepatitis, which is contagious, just as deadly as HIV and much easier to catch from someone else than the HIV virus.
Legality would come in if the results of the tests (HIV, Hepatitus) resulted in denying employment with positive results. I believe both of those are judged like a handicap, at least pos HIV is, and you can't be denied based on that just like any other physical handicap if it doesn't physically keep you from performing your job duties.
To be sure, ask why a blood test is needed. If you don't get a satisfactory response check with the local ACLU or legal services, especially if turned down for the job.

I would think that there is some kind of discloser information that must be made legally available to her as to what the test was used for. My best bet is that it is part of a drug test of some kind. Although urine, or a sample piece of hair seems to be a more common way to go with that. I sincerely doubt that they are checking for HIV or HEP. In any event, .. if she asks what the test(s) are for . . I believe they are required by law to disclose the nature of the test. Actually, I think they are instructed to tell her what ANY test is for .. BEFORE they take the test. I know I have always been informed if they are taking a test on me of any kind for employment .. exactly what kind of test it is and what they are using it for. She should most definitely ask them. I have heard of people in the healthcare field take blood test but I'm sure about teachers. (So it is not illegal)
