With a driver and a deceased - Yes for HOV-2
Driver only - No

No officer of the law would be stupid enough to pull over a hearse for an HOV violation. The papers would have a field day conjecturing why a deceased is not a passenger, etc. It's the kind of news that people like to read about.

Only an HOV-2 lane, unless there are two in the back or a passenger up front; then HOV-3 is OK.

Interesting question! If it's just the driver and the deceased in the coffin in the car, I'd say yes. But I am not a lawyer, so I am not sure.
