Depends on the law in your state.
I will answer for here in Texas.
.08 is Illegal for adult drivers
.001 or ANY detectible Alchohol is illegal for a Minor (under 21)
It is possible for the test to show less than .08 and you still get charged. If you fail a field sobriety test and yet pass the breathalizer you can still be charged. In this case It is assumed you are one of those that is affected more strongly by alchohol and the physical evidence of your inability to pass the test shows you to be drunk regardles of your current B.A.C.
Also your breathalizer test may be administer several hours later after you have been taken to jail and not at the scene when you were pulled over. in this case your less than .08 you blow then and the time lapsed from when you were last driving will be taken into account. Alchohol goes away at a predictable rate over time. knowing what your BAC is now. and going back to when you were driving and pulled over, they can determine what your BAC was THEN. and that is likely to be OVER the .08

This is all based on your age, the state, and a few other factors. You need to research state law. Tell you what though, 0.037 is so low, you could easily blow that after chewing gum, taking a shot of cough medicine, brushing your teeth, mouthwash, or a number of other things.
I haven't been anywhere in the US yet where the legal limit was lower than 0.08 if you were 21 or older.

If you are in a state were there's a "NO Tolerance " Law then yes. In Missouri we have that law and it stinks. You could be up late the night before drinking and if you get pulled over the next morning a blow anything you will get a DWI...

depends on where you live. Almost all places in the US are .08 so if your area says they dont' want you to drive with anything higher than that then I guess you have to follow the rules or pay the consequences.
