It's the magistrates and judges - they haven't a clue what it's like to be a victim of crime. I'm sure if some of the horrible things that happen to these victims happened to them they'd soon be banging everyone up. Also the CPS that don't even take some things to court that the Police have worked very hard at. The Police do all they possibly can and then it all falls apart.

The government, why?
1) the are in power, they have a majority in parliament and therefore can pass or rescind legislation
2) a lot of the legisaltion introduced inthe last 9 years is poorly though out, and badly drafted
3) The judiciary can only sentance according to the guidleines or 'tarif' set out by the Lord Chancellors office controlled by the government
4) The courts are spectacularly unsuccesull at collecting outstanding fines because the Lord Chancellors office doesnt let them (or the Police) take effective action
5) Jail sentances are laughable because the jails are at or near capacity becasue the government is slow to build new prisions
6) Offenders know the chances of getting caught are low, even is they are caught the 'cost' of the sentance is low so its no big deal - owner of the problem the government
7) a lot of the EU legisaltion is UK interpreations of EU policy - most of the really daft screw ups are the UK Beuarocracies adding lots of daft additonal, and poorly thaught through requirements.

B The Police are hamstrung by increased paperwork and beaurocracy (imposed by this and previous governemnts), money constraints caused by this governemnt (increased pay & pension, increased workload, but proprotiantly less cash

C The judiciary are controlled in sentances by what the law says and what the government tells them they can do

D Victims usually want the maximum and seek some for of vengance. They tend to see any crime they have suffered as the worst category for that crime 0 their expectations of the court system are unrealisitc - supposedly the courts are about justice not vengance

So in short its the governments fault, but we elect the governemnt so in reality if you are seeking someone to blame its actaully our (the electorate that voted this government in) fault.

The premise of your question is wrong, namely that severe punishment stops crime.

The only purpose it serves is to satisfy people's thirst for revenge and to help criminals to get a better "education" in their chosen field, being stuck with other criminals 24 hours a day.

The only thing that helps prevent crime is to increase the chances that criminals are caught. This has been shown time and again by studies on the subject.
Politicians and the press ignore this, because they like people to be afraid, it sells newspapers for some reason, and one of the all-time best ploys for politicians to get elected is to be seen to be "tough on crime".

If you really are on the side of potential victims you should insist on a program of education and social re-integration for prisoners, as well as increasing the efficiency of policing.

house of lords have to approve the law, government have to make the amendments so they are.. the worse and most ineffective law, which tie up loads of police and court time is the asbo... waste of time and money!
