Very, very few participants in sham marriages are ever caught. Marriages for immigration papers are a scourge in North America, Europe, Australia and wherever migrants who have money to pay for them want to go.

So long as the couple stay married for two years, and especially if they live under the same roof -- different rooms OK -- prosecution is impossible. If they live apart their chances of being caught are slim, the chances of punishment if they are being minimal if they have a plausible explanation.

Here is a thoughtful and correct legal analysis of the issue from a USA standpoint:
http://www.nolo.com/product.cfm/ObjectID/E0F68B91-2668-463B-8524281B1AB24AB9/sampleChapter/4/118/
"It is illegal for anyone to get married solely for the purpose of getting, or helping someone to get, permanent residence in the United States. There are stiff fines and possible jail terms for people who are convicted of this crime. But we would be foolish not to address the fact that many people attempt to fake a marriage to obtain a green card." (click on link above to read the rest)

Even in blatant cases, nothing happens: I was told, regarding a woman who, when a small girl had played with one of my daughters, that she had married a gay (i.e., homosexual) Irishman out of charity and not for money so that he could get a green card. In the interim she had an affair with the gay's roommate, also Irish, and got pregnant. She waited the obligatory two years, divorced the gay guy and went to Ireland with her lover and married him there. Where they are now living. (The problem now is the legal paternity of the infant and the evidence a DNA test would suggest for the sham quality of the first marriage. But prosecution is wildly improbable, and the first husband is now eliigable for US naturalization.)

Marriage rings operate in Britain, which is why they passed a law requiring non-EU/EEA/Swiss brides and grooms to have a special marriage visa if they are not permanent residents. http://talkpolitics.users20.donhost.co.uk/ (The law was declared by a court to be a violation of the European Convention on Human Rights right to marry and raise a family, but it is thus far still in force as far as I know.)

Nothing. They cannot legally prove she did not love or even like him. If I remember all you have to do is get married and live together for a year or two. Get a divorce and he or she can stay legally. Then start over.

All marriages have static. They have no case.

A horrible marriage, if she (or he) is willing to be dishonest about who they are then the rest of thier morality should be questioned as well. Been there done that bought the t-shirt. I speak from experience.

Deportation for them.

Fines and possible jail term for the other.

Really, is it worth the bother?
