I used to work for Jack in the box, but was being harresed by one of my supervisors, so I put my arm around his shoulder (like a friend would) and told him nicely to discontinue. The next day they fired me because the said they had a no touching policy. Although I see people constantly giving hugs high fives, pats on the back, ect... I called Jack in the box headquarters about 2 months ago, and since then nothing happened, but there is a restraining order from me and the fast food place. Was it legal to fire me?

Are you sure thats all that happend? They just dont pass a restraining order out for putting your arm around somebody.

If thats all that did happen , I would say he didnt like you
I would also say you were made a example of.

Legally? You bet you hairy-*** you was. You violated a company policy by putting your paws on the manager. As WUXXLER said, I would have fired off on you quick fast and in a hurry for touching me, especially if you put your hands on me and told me to not do something again. That is what I would percieve as a threat and with you already in my personal space, I am sure it would be legit. The high fives and back-pats and all that other stuff is plenty ok with everyone so it is accepted. If you called the home office and told them one of the employees slapped you in the hand when in fact it was just a high-five, the offending employee would probably be canned as well. Now if you try to do that now, they will probably laugh at you and say you are just looking for retribution for having been canned. As far as the restraining order goes, I can have a restraining order filed against you simply by going to the court house and saying I am scared of you and feel you might come injure me. Take that as a compliment. The manager is worried you are gonna retalliate and scared that you may be able to carry something out. Like JUDITH said, get you another job, I am sure that Jack in the Box did not pay that good in the first place. Good luck to you in the future, whatever route you decide to take.

Unfortunately for you, it was legal for them to fire you. You had no business putting your hands on your supervisor or anyone else. Too late now, but for future reference, you should have called HR. They would have followed-up your allegations with an investigation. A company the size of Jack in the Box doesn't look for lawsuits and would much rather solve the issue at hand. It may have been your supervisor asking the question instead of you.

Find another job and chalk it up to a lesson learned. Good luck.

you need to reread your hand book on the policies of jack in the crack and if you were in the wrong you have to tough your loss,but if you weren't in the wrong then you need get all of your info together and call the labor law (your unemployment office should have this # and or your phone book) to see if you have a case if you do then the labor law will investigate and get back to you, you can also call a lawyer who handles cases like this and get a free consolation.....word of advice the next time this happens when you start to feel like you are being harassed then you need to take the chain of command and always write down what you say when you said it what time you said it and if the boss doesn't take care of the problem then you keep going up the ladder until something does happen they cant fire you because you feel like you are being violated and you are taking the right steps and when you are in a situation like that you need to always be on you P's and Q's.....good luck.....and hope you find a job where the people don't treat you like crap

Well, if you did disobey a policy of the "Employers policy", then Yes.. However sounds like you are not the only one. If you feel you really where being Harassed by this Supervisor, you should seek an Attorney asap. The longer you wait the harder it is on you. You will have to prove your allegations. Might make a list of other employees that have witnessed the Supervisor in his/her act of harassment... Best of Luck to you....

If they have a policy, and you violated it, they were within their rights to fire you.
Personally, if I was your boss and you put your arm around my shoulder, I'd have broken it off and handed it back to you. If you feel that you are being harrassed in the workplace, follow the chain of command to report it instead of making threatening gestures.

Your attitude in this forum indicates to me that your little "hug" was meant as intimidation, (I suspect they also interpreted it as such, else there would be no restraining order) and I think they have every right to keep you out.

Checking on your previous questions informs me that you have a history of such problems. It may be time for a little reflection and self-examination.

probably not, but, you can get work elsewere, and make more money. Big American corporations tend to do that kind of thing all the time and get away with it, since it is your word against your manager's word, and they always believe the manager.
