I would not hesitate to go to the police and talk to them about it. they can get a restraining order in place until you can get a custody hearing set. you need to document all of this in a journal, so that way if you need to talk to an attorney all of the information will be right there for him/her to reference.
you already know deep in your heart that this is not a good situation (that is why you want to leave him), and now it is escalted out of control. you need to get back into the driver seat and take control for you and for your child. good luck dear and stay strong, you will be doing the best thing for your well being

Are you married to him? No. That means the father has absolutely no custodial rights over your daughter. Trust me, I've been through the child support division to know better. In order for him to have custodial rights, he'd have to take you to court over it. Since he's threatening to kidnap her, and you're serious about leaving him, call the cops, file a police report and your countys prosecuting attorney will pick the case up and put a warrant out for his arrest. Threatening to kidnap a child is the same as doing it. Especially these days when anything that involves a child is taken seriously.

Go to court and file for emergency protective orders (ex-parte), let them know if your child is in danger. They will make immediate orders if they feel your daughter is at risk. You can often get court waiver of fees. In most cases a father can not walk into court and walk out with custody without a hearing unless there are reasons beyond a reasonable doubt that you are not capable of having the child. Leave, do not allow him to see or take the child untill an order is in place, and you know he is safe, and won't flee with the baby. Don't let him use your child as a tool. Good Luck

Yes he can so don't let him.If neither one of you have custody and you are both the parents he can refuse to give her back and the police can not do much about.I know this from experience.The only way they would be able to take her from him is if you had custody.A restraing order against him would work if he was harming either of you.Call social services or some where to find out what you can do.Just take your baby and leave.Go to a family members house for a while.Do not stay just because he is threating you.My aunt did that and got beat for 11 years.She was to scared to leave.When she finally did he had all ready ruined her life.Good Luck to you and your baby.Hope all goes well!!!

I have been in the same situation with my son his father is a dead beat i left him back in Oct05 and still battling custody and he has never paid child support or help me he also filed income tax and my son never recieved a dime from that also I raise him all by myself and my son just celebrated his 2 nd b-day and no gift was brought to him and my son dosen't know who he is now I went to legal aid from my state and they can help you in a situation like this and don't tell him just pack up and leave and then file for child support and get ahold of the lawyer and then your state will help you and he may get visitation but if your scared he might kidnap your child ask for supervised visits my ex did try to kidnap your child.

It is not kidnapping if it is his child. That child deserves to have a father just as much as she deserves a mother. The two of you really need to think about what is important. What is important is the child. When a relationship ends people do and say things they later regret. And believe me you will later regret not working things out with him in a civilized manner. It's hard to look your child in the face and see their pain. They are the ones who suffer. The parents eventually get over their anger after the hurt goes away. For children it is much harder.

First , go to the court house and get an injunction on him ( aka restraining order ) , then contact the police and let them know whats going on , if she does turn up missing then he's in trouble. Talk to a lawyer and get full custody

Just been through this, write down EVERYTHING that makes him an unfit parent, even witnesses. Go to your police station, let them know what is going on, even if it means having a restraining order on him or whichever. Go to your courts, apply for full custody and be prepared for lies or anything he says, be strong and good luck. (tell them about him threatening to kidnap her)

he has at this point just as much right to take the child as you do the only thing to do is beat him at his own game leave when you get the chance and follow up with emergency shelter if needed they will put you in contact with the right people then it will go to court usually the judge gives the child to whoever can provide the safe environment good luck.
