my daughters biological father has not seen her in over a year. he came to see her every day while we were in the hospital and then 3 more times when i took her to see him before she was two months old he has had no contact with her since and i don't want him to get a wild hair and come and try to take her so is their a way to get his rights take away

Get yourself an attorney. You should have already had one before you had your baby so that the father would have had to pay child support. If his name is not on the birth certificate then he cannot force an issue, but if he had his name put on the birth certificate maybe he can.

Honey, i can understand how much u love your child and don't want to part with her.But as far as i know i don't think there is any way particulalry if he is the biological father to have that right taken away.Really at the end of the day its not what u want...or what the father wants but what courts and the law term as 'Best interest principle'meaning they would take a decision basing themselves on the facts of each case and seeing if it would be in the best interet of the child...there are many elemets in it but basically it is self explanatory.Good luck

Unless you were to get married and the guy is willing to adopt, this is about the only way to get his rights taken away. You can take him to court and sue him for child support. Most states now garnish child support directly out of the guy's paychecks, or they take tax returns. You can have a custody/visitation agreement, so he cannot just show up when ever he wants.

You would have to file abandonment charges in your state, and you would have to be truthful when it came to what you feel his last known whereabouts were and any other information you may have (phone number, etc) The courts will then try to contact him regarding the charges you brought forth and it will then be his choice to fight them - and get joint or full custody and visitation...or ignore it and his rights will be terminated.

Bear in mind though, if you do terminate his rights, you are then no longer eligible for child support from him.

My friend wanted to terminate her babies fathers rights as well and when she asked about it they told her the father would have to sign over his rights to the child and if he did not want to do that she would have to take him to court and prove he does not care about the child or that he is not a fit parent.

Those are the only two ways, sorry.

Two options, take him to court to make him sign up his rights, but the court may say no but he will have to pay child support if he want to visit with her. Even though he may be a dead beat dad he still has rights. Or you can contact him on your own and ask him to voluntarily sign his rights up to keep from paying child support!!!! It kinda works out in your favor either way.

I personally don't believe in taking away a parents rights for any reason unless it's abuse. And I really don't think you can. And most cases he wouldn't be able to just up and get her for no reason. Judges are very difficult to persuade to take a child from the mother.

My daughter's father has not seen her in nine years. The only way I could have his rights taken away is for my husband to legally adopt her. They would not take his rights away any other way.

No you can't take his rights. He has to sign his rights off. You can go to court and try and convince a judge that you want sole physical custody and he can't have visitations or anything. But as far as taking them all away no.

Economic independence is one prerequisite. If you do not have alot of money for a legal battle and are on government assistance it would be more difficult as he is economically liable. If you are getting child support generally you have to give up the child support to get his rights taken away.
