We are trying to get custody of my husbands 12 year old daughter. Her mother has been in involved in drugs and various other run-ins with the legal system. She has several possesion charges, theft and identity theft. She is never home and leaves the little girl alone for several hours without telling her how to get ahold of her. Her mother is verbally abusive and allows her boyfriend to be the same way to my step-daughter. My step-daughter spends all of her time in her bedroom so that she does not have to "deal" with her mothers boyfriend. This little girl is a straight A student, very active in sports and desperately wants to live with her Dad and I. She just started school and she found out that her mothers last drug charge (June 22,2006) was published in the local newspapers, she was embarassed and ashamed. All of her friends and parents are aware of her mothers drug history. What do you think the outcome will be????

With her mothers past (and apparently recent) run ins with the law you all should get custody. I would suggest family counseling for all of you to help her adjust and hopefully help her deal with any issues regarding her mother before they develop into something serious later in life. Also, find books on blended families to help you better understand her and help her.

Sounds like a sure thing for you. Drugs are about the only thing that'll keep a child from the mother. No matter how great the father is, if the mother is verbally abusive but gives the child the bare minimum as far as food and shelter go, the kid stays with her. But drugs change things. As long as you and your husband are fit (as I'm sure you are), and especially since she wants to be with you, she will. You don't even have to have a lawyer, if you don't want (true in NC, at least). Well, you certainly have a great chance of getting her since the mother is unfit. The fact that the daughter also wants to live with you is another plus because she is old enough to talk to the judge about how unhappy she is with her mother. Providing you have a good lawyer I don't think you will have a problem getting her.

if thier mother has been in all that trouble then why has,nt someone tryed before to get them kids out of that.which proveing
a mother as unfit is really hard because the law helps the ones that really doesnt want to be the mother to them kids like she is supost to.belive me i know because me and my husband went threw the same thing toward his exwife and the courts said that as long as the kids has food and a place to sleep then they dont see where she is doing anything wrong.so i wish yall all the luck,.

As long as her father doesn't have the same types of charges against him or abandonment charges, he will get custody. Otherwise, sounds like grandparents can step in or it's foster care.

it sound like your husband has a good case if his history is better and yours as well they might wonder however if this has been going on for 12 years why it took so long for him to get involved.
i wish the little girl luck it sounds like she needs someone in her corner.

It seems to me that you have a very good chance of getting full custody of your husbands child.
