The mother is getting the child support and going on shopping sprees while the child is living with other family members. The mother says she needs it to live off of because she doesn't want to work and will not give the other family member who is taking care of her child nothing.

There are State law governing child neglect. If the parents neglects well being of the child.

Neglect is failure to provide for a child's basic needs. Neglect may be:

Physical (e.g., failure to provide necessary food or shelter, or lack of appropriate supervision)
Medical (e.g., failure to provide necessary medical or mental health treatment)2
Educational (e.g., failure to educate a child or attend to special education needs)
Emotional (e.g., inattention to a child's emotional needs, failure to provide psychological care, or permitting the child to use alcohol or other drugs).
When a family fails to use information and resources, and the child's health or safety is at risk, then child welfare intervention may be required.

You give no details: how is she using this money, and how do you know this?

As others have pointed out, if she's neglecting the child, bring in family services, but if you simply disapprove of how she spends the money, then there's nothing you can do.

If the money goes to food, shelter, transportation, utilities, etc. then it's not for herself.

If it's for drugs, clothes for herself, dinner out for herself, etc. and you can prove that it's the child support money and not her own money she's using, then you might have a case.

So, which is it?

It sounds to me as though, if they are willing to take her, those who are caring for the child should seek custody. You don't really want that child "cared for" (neglected, no doubt) by this mother, do you?

I don't know whether the child support would then go to the caretakers or what, but if she doesn't get custody, she won't get that money any more (or so I'd imagine).

I wish I'd asked for your role in all of this, and also about the father. If he is willing and able to care for the child, then I'd suggest he try for custody.

If the child is provided with clothing, food, shelter and the basic necessities it would be hard to prove that the mother is using the money for herself....

If the child is being neglected and is in need of basic necessities, contact your local child protective services office IF YOU CAN PROVE IT.....

and unfortunately you have to let them take it from there, or another alternative is to try to get custody of the child, but you would have to prove the mother to be unfit, and that can be VERY difficult to do sometimes...

Laws do vary from state to state however, so you may want to contact your local CPS office and ask them.... They could give you a better answer, because they know how the system works in your state!!!

If the mother is spending all the child support money on frivolous things and neglecting the child, you can call Child Protective Services. They will visit and make sure the child is being well taken care of.

If the child is being cared for, housed, fed, clothed, doctor's care, then what do you mean, "Blows it on herself."? Are you saying the child is NOT being taken care of? Then it is off to family services to get custody. IF the child is being taken care of, I think you should be thankful and leave it at that. All is NEVER as it would seem, is it?

NOTHING so get over it.

How can you prove it? What do you want to do audit her to see if she spend the child support amount directly on the kid? Keep in mind part of her rent, grocery bill can be "claimed" as being for the kid. He has to eat and live somewhere. She also needs to drive him to school and where ever so part of the car cost is due to him.

Stop trying to get out of your responsibility!

a parent that has custody has expenses involved with housing and other things.
If there is something wrong with the other parents care. Document your claim and take it to a judge.

what can be done about a parent who abandons parental supervisory dutys 80% of the time and just visits when it suits him/her not the child?

well i,m going to tell you just like the courts told us,regardles what the mother does or how she spends the money because its her to spend,and that there is no law saying what they have to buy when getting childsuport.just as long as its not on drugs.good luck

absolutely nothing; and if you complain there's not enough money for the child, don't be surprised if your support gets raised!

nothing, becuase as long as the child is fed, clothed and sheltered the state does not care.

it is sad huh? My boyfriend's baby momma does the same thing.
