It might only be a fine and/or he might get excluded from returning for a period of time. Check with the Immigration and Naturalization Service..

well if he's planning to leave, the worst that could happen is a fine, if I'm not mistaken
if he wants to stay, that's another story... overstaying a visa means that, as another answerer said barring marriage, you would have to leave and apply for another visa, wait in line for it, and of course you need a waiver from the secretary of state in order to be eligible for a new visa despite staying longer than allowed on the old visa... also I'm not sure about marriage because status change may only be available with a valid, current visa... although it may be doable through waiver, but it will be hard to convince them he married for love. and if he doesn't, that's a crime.

Well he is now illegal but the united states still knows that he is here. He is still able to get married to fix his papers, and if this amnesty goes through then depending on how long he has been here he should be able to qualify for it. My husband has been here for 5 years now and he came on a tourist visa. We just got married and now I will be able to fix his papers for him, and then he can apply for citizenship once he has had his residency for 3 years.

i think the best think to do it go back to his/her original country and try to comeback on a new visa, the longer the friend stays the worse
