i mean really? it had an orange tip and everything.... yea i got arrested and now i have court but come on, what if it was a little kid, say 9 yrs old who pointed his toy gun at a pedestrian... would he have been made to get out of the car with a cops real gun pointed to his head??

Yes, I believe it is illegal. That's the reason why now all toy guns have the orange tip...to distinguish it from the real deal, but the tips can be broken off. The days when a, as you said, 9 year old kid can point a toy gun w/o fear of some form of retaliation are long gone. Here in FL, we have a kid who got something like 26 years *I think he was 13 when he was convicted for fatally shooting a middle school teacher. Anyone remember Nathaniel Brazil?*
Anyway, yeah, brandishing a toy gun can lead to more grief than it's worth

Well if a nine year old was driving a car he would be in a lot of trouble anyway toy gun or not. But you are not nine and so you should quit acting like it. People don't always see that orange tip all they see is the rest of what looks like a very real gun. A quick cell phone 911 call later and ...yes the police are responding to a man brandishing a gun call and hell yes they are gonna' take you out at gun point!! Lucky you didn't do anything stupid(and from the sounds of it it was just luck) or you wouldn't be able to tell the tale.

Brandishing a weapon is to establish power and control.
Yes or No.

Police put themselves in danger every day in the line of duty.
Yes or No.

The pedestrian in this scenario may have been terrorized.
Yes or No.

Not everyone knows that an orange tip means it is a toy.
Yes or No.

When faced with a potentially deadly situation the police will use extreme measures to subdue the perp.
Yes or No.

You, as everyone is bound to be, were very uncomfortable when a gun was pointed at you.
Yes or No.

Here's a clue to the answers to these questions. YOU WERE CLEARLY IN THE WRONG!!!! I do hope you are prosecuted to the fullest extent of the law. Weapons of any kind are not toys and if you need toys then you ARE NOT adult enough to brandish any kind of weapon, whether you are "playing" or not. Good luck on your probation or your jail sentence.

Yes it is a form of felonious assault. There were cases in the paper where a kid brandished a toy gun and did end up getting shot in error. If the "getting out of the car with a cop's real gun pointed at your head" part is what happened to you then you were doing more than just a comic bit of brandishing. It sounds like you were trying to imitate a road rage nut case by threatening a pedestrian. If you end up with a felony conviction on your record that should answer your question for you.

a few years ago some stupid teenagers where walking down the street with a gun that looked so real. they were pointing it at houses and just having a ball. The police were called. They no longer were having fun. Cops cannot take the chance that its a toy gun or a real gun painted to look like a toy. Whoever this person was will need to find a better way to occupy their time.

You can be charged with serveral things, if people are afraid, or if you upset the public, you have causing a distrubance, or distrubing the peace.

Next in the 2 seconds you turn and point it at a police officer, do you want to risk your life on that fact he will see the orange tip, or perhaps be concerned you painted orange on your real gun. If given a split second to decide, you may find he did not beleive it was a toy gun.

Yes it is. You are making a terroristic threats.
What if I had seen you and didn't see the orange cap and shot you with my real gun?

We have a simulator that shows a life size projection on a screen and it is computer controlled and officers interact with it. One of the simulation is just that a guy with a toy gun. He ends up getting shot 9 times out of 10 when we run cops thought it.

Think about it. and yes for the record I shot him 3 times the first time I went through it.

Unfortunately, the last kid that I remember around here that brandished/pointed a toy gun at a police officer got shot! They didn't know until afterward that it was a toy gun. Really, not something to be playing around with.

If you were doing it in a threatening manner to the point where cops had to draw their guns on you, yes, it's illegal. You should be thanking your lucky stars you didn't get shot!

Orange tip or not, the police could have shot you, especially since one should figure you'd have more SENSE than a 9 year old. I hope you learned something from this: oh, and please don't go provoking pit bulls on the end of weak chains, either!

That is what your trial is going to decide. It depends on the law of your city. In Dallas you cannot have a toy gun unless the orange tip is CLEARLY visible. That is the part that will probably get you. All the cop has to say is they did not see the orange, and your guilty. Good luck.
