I lost my brakes one night and couldn't stop for a traffic light last December. I had no choice but go thru it. I fought the ticket in court and lost. The judge also put the points on my class A-CDL. Under the circumstanses of loseing my brakes can I have the points removed from my license? It was an emergency situation and I should never had points added to my license for it.

How did you fight it exactly? Did you take a mechanic with you to show that you indeed had problem with your brakes. Along with the receipt that showed that you fixed your brakes? As far as the emergency situation goes, that is something that the court will never let you use as an excuse (unless it was life or death). Even then, I have seen people who had emergency situations and still get hosed by the court. Just depends on the judge in the end. Removing the points is probably not going to happen.

Unless your state has some provisions for point removal, I think you are out of luck. CDL holders can no longer take defensive driving classes for citation dismissal in the US, so that is not an option.

I am curious as to what you were cited for - running a yellow is not illegal as far as I know - sure you weren't cited for running a red light?

Actually, the driver is at fault if they loose their brakes. It would indicate poor maintenance on the vehicle. What if it were a red light and you smashed into traffic?

I would feel lucky that it was only a yellow light with a ticket, then someone else's father/mother.

no they wont take them off there,they are kind of unfair when it comes to tickets these days,,but once there put on they,ll stay for a few years,,i went through the same thing,,and has 3 points on mi license for 3 yrs,,before they ever came off,,good luck,,i hope this help,s.

traffic school or a good lawyer i have had around 40 ticket and i still have a license and no points on my license

You might be able to get the ruling overturned, if you have proof of your bikes malfunction from a certified repair shop / inspection station. The proof would probably have to be within a week of the incident.

I don't believe your brakes failed. Sounds like a B.S. excuse that the judge didn't swallow either.
