Biologically he is the father but it is your choice on whether or not to put him on the birth certificate. Unless court ordered to do so. And if he isn't on it he isn't legally reconized as the father unless he files for a paternity test and then proven as the baby's dad.

It all depends on the laws in your state. In California, The father would have to take a paternity test and then petition the courts for custody. If he is willing to go the distance he can get custody, but only if he can prove that you are an unfit mother. The middle ground would be that you would both have to share custody. Make sure you document everything said and done by both of you regarding your child's health and well-being.

In most states the mother has full custody rights. He literally would have to sue you for custody and if there is no real reason to place the baby with the father (obvisously you are not a drunk or a drug addict) they probably will not place the baby with him. He could however gain visitation rights IF you are asking for child support.

I suggest talking to a lawyer about the laws in your state/province because it's likely and logical since he is the father that he can get a lawyer and gain certain rights to the child.

IF NEITHER ONE OF YOU HAS CLAIMED CUSTODY THAN HE HAS THE SAME RIGHTS AS YOU I WOULD GO DOWN AND GET LEGAL CUSTODY RIGHT AWAY! IF HE IS NOT BORN YET DON'T PUT HIM ON THE BIRTH CERTIFICATE THEN HE WILL HAVE TO PAY FOR A PATERNITY TEST BEFORE HE CAN CLAIM THE CHILD TO BE HIS

why worry. i wouldn't. just don't let him sign the birth certificate. if you REALLY want him out of your life. i wouldn't be bothered. man, this is going to be 18 years of drama. if you don't want that, i would just stop talking to him. tell him you had an abortion. and move on.

By not marrying you, he gave up any parental rights. It's up to you to make any and all decisions for your and your little one.

he has to actually prove that you are unfit as a mother.....the mothers usually get full custody of the kids before the fathers do

if you are not married he would have to be with you to register the child if he wanted his name on the birth certificate.
