I would depend on the crime that was committed and the other conditions. If they were involved in an incident then the statement might be to clear them so they will not have to be arrested. You can be a witness or go the jail can be true in a lot of cases. There may have been a fight in which the parties were involved. If the party claiming to be the victim refuses to cooperate then both parties are charged. But a witness who is just a witness cannot be forced to make a statement.

They can "threaten" anything they want for the most part. They can lie to you to get you to spill the beans, it's legal. They can't lie (officially) under oath but they cerainly can tell you that if you don't squeal on your buddy who broke the law that they will arrest you. Matter of fact, they can arrest you as a material witness if they REALLY want to get your story.

My father is a retired officer. He used to do "illegal searches" on vehicles. Not just to do them but because he had a good reason but probably not reason enough for the "reasonable cause" requirement to hold up in court. Funny thing......he'd find the drugs or weapon and the kid that had them would be HAPPY not to be getting arrested. Yes, the search was questionable because reasonable cause would be difficult to prove but guess what? The drugs or weapon were off the street and the kid that lost it/them was usually happy to be able to go on his way without getting busted. When you find illegal stuff in an "illegal" search all it means in real life is that the law breaker gets a break because the cops won't be able to use the evidence.

So.....if the cops ask for cooperation, GIVE IT TO THEM. One of these days you'll need them and if someone is saying "I don't want to get involved" you're certainly going to want the cops to do whatever they can to get to the bottom of the case.

usually these are scare tactics to gain evidence to help in a case. If a person is giving a witness statement, they can't be arrested because a witness statement is a voluntary submission. If a person is caught doing something wrong they have a right to remain silent and any evidence can be used against you, so you do not have to say anything unless you want to.

Sorry, your question doesn't make sense. Do you mean a statement as a witness? There is a law on many state books about not reporting a crime being a misdemeanor.

Intimidation is a police officer's favorite weapon. The 5th amendment is the best defense. Plea the fifth and nothing can happen to you unless the officer has probable cause to arrest you or your friends.

They can threaten anything. But a lawyer will ask what specific law the person is being accused of breaking.
