Here is the scoop on trying to enforce the law, as a citizen.
1. If you call the Customs and INS folks, and they can't respond to the situation, you end up having to release that person. Don't try restraints or making your own 'prison' which gets you branded with unlawful restraint...
2. Most local police either have no guidance, or have been informed that their services are more needed elsewhere.
3. If you do make a citizens arrest, you become liable for any and all damages, or lost money, income, property, due to that arrest, even if it is legal! The Civil Courts will gladly hear the case of an illegal who claims that you stole the $5,000.00 he saved from working the past year!
In my frustration and angst over my government ignoring the most blatant violation of MY rights, in permitting illegal aliens to cost me money, I whoop for joy everytime the INS arrrests and deports another bunch of them!
Loved it when the contractors arrested at a Federal site were mostly illegals! Problem is that it is multiple arrest times, at multiple Federal job sites, for many. They get deported and are back next week!

Technically a citizens arrest is an act taken against a recognized officer of the law. Guess the answer is no.
Hold him/her and you are liable for kidnapping and a host of other crimes. At least in the USA.

Probably won't do any good. Local police have detained illegals, and the Federal immigration authorities have refused to come get them, so they got released.

Yeah, not that anyone in this politically correct country will do anything about it. You can't run a stop sign, but you can cross our border illegally, get health and social services for free, get a driver license, and vote, but no, you can't run that stop sign.
