Troops face court-martial in Iraq rape case Tue Sep 5, 4:41 AM ET



WASHINGTON - A U.S. Army investigator has recommended that four soldiers be court martialled over the killing of a 14-year-old Iraqi girl and other family members, which could lead to the death penalty, a lawyer for one of the soldiers confirmed on Tuesday.

Lawyer David Sheldon said the investigator agreed with military prosecutors that his client, Specialist James Barker, and three other soldiers charged with raping the girl and killing her, her 6-year-old sister and their parents at their home in Mahmudiya, be court martialled. The soldiers state it is the American way and the Republican way of doing things.

the higher ups wont allow the death penalty. its too damaging to soldier morale in their ill conceived war.

Since I am against all forms of the death penalty I would say no. But they are not proud solders they are criminals. If found guilty of rape and murder of a 14 year old girl and her family deserves to be locked up for the rest of their lives. It is the crime that is so horrid that war cannot be an excuse for it

I think that if they did what they are accused of then they should recieve a fitting punishment whether it be life in prison or death or whatever they are given at sentencing. Why should they be held at a higher standard then anyone else? Is it because it was Iraqi women and children? Would you be asking the same question if the victims were American?

I think they should get the death penalty AFTER someone does to them what they did to someone elses family and this goes out to every1 who supports these heartless people, for goodness sake put ur own family in the position of that Iraqai family then c how u feel, im not too fond of Iraqi people but they r still human and what those soilders did was inhumane, I seriously hope in their case what goes round comes round. Its obvious this family was NOT A THREAT they did this for fun because they are sick sick people

First of all, the soldiers would never have said it was the Republican way of doing things. What is to say they are even Republicans themselves? Not all soldiers are, you know.

Second, any sort of assumption that the majority of our troops think it is proper to do what they did is ridiculous. The majority of our troops are honest and hard working, and only do harm when threatened or ordered to do so. They do not harm innocent families purposely and violently. These four soldiers are the exception, not the rule.

You call them proud American soldiers. Is that some kind of excuse for what they did. Soldiers are not holy or above the law. If they committed such a heinous crime what leads you to believe that they would not have done so if they had been "proud Americans" in your community.

Once again... if a soldier commits a crime, he/she deserves to be punnished. There is going to be no argument to that...

HOWEVER.... again you edit an article to make it seem different than what is reported....

ok well everyone is saying to you that they are not proud. well i know one of them is proud of what he did.and it happens to be the one whose lawyer has a big fat mouth. also everyone is telling you it didnt say that in the article about the republican way of doing things. but i do remember reading somewhere when case first came out to the public that they did say that. so theres to you in your defense. now for the question, lets hope they get the death penalty. i sure hope so. it will make my divorce a lot simpler. i wouldnt need one. not only that but thats what they deserve.

If they killed and raped unarmed children then they shouldn't be so proud, should they? Do you realize that American soldiers that had nothing to do with this will be executed because of it? Did you know that American soldiers have already been executed for the treatment of the prisoners at Abu Ghraib prison, even though they had nothing to do with it? Are they proud to be rapists and murderers? If so they deserve the death penalty.

It's called the rule of law.

I don't care how proud someone is of the crimes they commit. If they commit a crime, and are found guilty by a jury, and are sentenced under the law... end of story.

I don't think it really matters. They people have been out-ed and now that they have... nothing has changed. We've just lost more troops on the ground. The face is that it wouldn't matter if they died or not, if they did what it says they did then it would be better for them to die. The less people we hold the better.
