I worked a company for 4 month (Dec '05 - March '06)supposed to be paid under table.I don't have tax ID or SS# since I'm a student.The boss who is CEO disapper after Feburary and there's unpaid pay about $3000.

I've kept e-mailing him,calling him to ask the pay but never responsed. I'm sure he knew it's violation of immigration to work for my visa state.

He has another emplyee who is same situation with me but the employee had been paid until May and haven't paid for him for whole 3 months.

In this case,could I bring this to small craim court?If it is,what kind of evidence or info should I need??

I'm really desperated.Any help could be great for me.

You can sue for wages lost. You will have to have proof that you were employed by him and that he didn't pay you. That will be hard since it was under the table. It's illegal for him to have hired you with your status but that doesn't mean he can't pay you. To a local search for Immigration lawyers along with Civil Rights lawyers. Work done should be work paid.

don't listen to the other too foreigners they don't know what they're talking about.

I call them foreigners cause there people didn't come from this side of the world. Mine did. And I'm still Legal lol.

Serves you right. This is the chance you take when breaking the law, and working for someone that is breaking the law. Even in small claims court you can not sue if you where committing a crime in the process of the claim. It would be like a drug selling trying to sue someone for not paying them their money. It just wont happen.

Thats like buying some coke off a street corner dealer, and then trying to sue, the dealer becuse it turned out to be sweet-n-low.

or

Trying to sue the person you held up the kwik-e shop with, because he did not split the loot with you 50/50 .


You are a criminal, you work outside the law, so you can't expect the laws to come into play in your favor.

You would need some kind of proof of your employment or an agreement between the two of you. I will assume that you don't have any kind of papers that say you were working for him since you were being paid under the table, so that will probably be hard to prove in court. You might be able to use that other employee as your witness, but thats about it.

Fool - listen to your own question. You do something illegally and then when the person you engage in illegal activity with screws you... a) you're surprised and b) you want to sue them??? Figure it out - if the guy is willing to do one thing illegal (hire you) then why should you be surprised that he is also a theif. Get over it, learn you lesson, and next time do things ABOVE the table, not under it. But please, don't waste the time and resources of our already overtaxed legal system.

you should be locked up for breaking the law , yet you think you can go to court . this is like suing your drug dealer for not giving you the right amount , you can't sue for an illegal deal not going as planned . i wish i could give the owner a high five for screwing you over

I don't think you will get anywhere. A lawyer will cost you more than what you're being owed. Second, illegally here, two crimes, don't think so.!!! That's the price you pay for illegalities, can't be rewarded for that.

No you can't come over here illegally and tie up our court system and sue anybody, when what you were doing was a crime in the first place.

An illegal already tried something like that, and it didn't work. Also, if you go back to where you came from, I am sure they will pay you legally.
