No, that is assault. Nobody can put their hands on another person. You could take action however, was your son hurt? I would say that you should spend alot of time telling your son how wrong he was, rather than focussing all the blame on the adult in front of your son, because at the end of the day, had he not hit the other child in the first place, none of this would have happened. The last thing you want to teach you son is that when he does something wrong, you leap to his defence. However, I do think it is absolutely wrong what the other parent did. It is one thing to say you can hit back if you are hit, but quite another to hold down someone for them to be hit. The other parent's kid has learnt a very poor lesson. If it were me, I'd have a quiet word. You do not say how old the other child was, or if they were hurt. I say this only because if you press charges against the adult, and the child was hurt, they may file a retaliatory charge. Also, you have to live in this community. Could you have a word? That's what I'd do, although this person does not sound very reasonable.

Whether in Scotland or not, it is definitely not civilised to encourage the physical hurt of another being regardless of reason.
For an adult to do such a thing unto a child, it is definitely not a applaudable thing.
I suggest that you resolve this with that parent and talk to the children involved to find out what really went on, before you take legal action.
There are no specific laws regarding "Other Parents' Right To Hold Other Children (Hereby Referred to as the Others' Brats ) So That Their Victimised Children Can Make Victims of the Others' Brats"
But I am sure you can take legal action, although that might not be the best course of action to take, do calm down and think carefully for what is best for your child. I am sure that your child has to learn something out of this, and the priority is to teach him the right thing, not to address his grievances or yours!

No the other parent is actually guilty of an assault on your child simply by the fact he, against your child's wishes, restrained him. He could also be guilty of conspiracy to assault. I would report him to the police. You have got to show your son there are consequences to violence and also show this man and hopefully the son the same. The man sounds like a bully and if allowed to act in this fashion will create a bully in his son.

A child under the age of 10 cannot commit a crime, however the adult that held your son is guilty of assault and aid and abetting an assault, even though the other child may also be under 10

i do not believe it is legal for an adult in a non-guardian position to inflict, or assist in inflicting, corporeal punishment. I would discuss this matter directly with the other parent and explain why he/she did this. If you are not satisfied with their response, then I would report the incident to the police.
