why did he fail?? grades? My son is not doing so well in the 3rd grade either. where do they want to place him?

My son also failed 3rd grade and it is illegal to refuse your child in a public school unless he has been expelled for disciplinary problems. This is courtesy of the no child left behind policy. My son has a disability and missed all but 32 days of 3rd grade. Demand a meeting with the local school board president.

Failing a grade isnt a reason to refuse him entry into the same school. There must include a pattern of failure and/or a behavioral/health/missing school etc. problem as well. Check with your school district for more information on the school's decision.
It may be a good time to start 'fresh' in another school. Good luck.

First of all, is your son in Special Education due to a disability or special needs? If he is, then your son has more rights, not less rights.Special needs include ADD/ADHD, Autism, and other disabilities. If your son is diagnosed already with ADD, and NOT in special education WITH an IEP (a plan for education specifically made up for your child's needs) then I'd ask the school WHY NOT.
If this is the case, you need an advocate to go with you to IEP meetings because schools can and WILL screw you and the child over where special ed is concerned. That's against the law.

You should still but your son in the regular school. If they don't let you put him in, try a different regular school that's nearby. But if there isn't, then try something other than a regular school for a while, if it works then you decide which path would be better for your son. But I don't think that they can keep you from puting your son back into regular school. Talk to the super intendant.

Why are they refusing to let him enroll back in school? With the No child left behind act they cannot refuse his entrance into the school system especially if it is the home district and if they do then they must provide transportation to the new school and they must find a school that will accept him as a student. Google FERPA rights and that should bring up more info for you.

Don't look at your son being put back in a negative light. Look at it as a way for him to master the skills he'll need to do well in the higher grades. Cause if he doesn't have the basic skills, when they start on things like multiplication and division in 4th grade, he'll be lost. My best friend's son had to repeat the 2nd and now he's starting 4th grade and he's getting almost straight a's. At first she was real angry and resentful because she saw it as a slight on her. So don't take it personally and just reinforce to your son that he needs to apply himself more in school.
As far him going back to regualr school....I'm assuming that you mean that you're trying to transfer him so he can be in his "right" grade? Nope, that's not possible. He's going to have to redo the 3rd grade. But like I said, look on the bright side and know that it's the best thing for your son in the long run.

What do you mean regular school? I dont think there is any law that says just cause a kid failed that he cant go to school. Call your school board or go to a school meeting. Unless your child did something to get kicked outof school, failing is not a reason to be banished.

What kind of school does he go to now!! I didn't think they could do that. I thought you could put him in any school you wanted you just kinda had to pay like a tuition or something like that. If your not happy with the school you can move him I do believe.

well, it depends on what's going on. i've never heard of someone failing a grade and being forced out of the school. was there any mention of behavioral problems? (i know this might be a touchy subject)
