yes! its legal.. but both mother and father have to have the piece of paper notarized.. you can have this done at a county building.. court house.. for around $10 or you can go to a bank.. all banks notarize for the same price.
your paper has to be legit.. name address of the new family you want to have custody of your child and time of date this new family will have custody.

Go to the Dept. of Justice, Custody,Adoption -
anyone answering this question, other than a Lawyer, specializing this this field, could not answer this question correctly.Your question was terribly composed - first of all "a person", must be the parent and both parents must give consent, that I am positive about. What the law is in California - ??? - each state is different. I hope and pray that this question was a lark!!!

At least in the state of Colorado, you can take a child to any Fire Station or Hospital and give the child to them. They are then placed in foster care and the process is started to find a permanent home.I think at that point it is assumed that you are relinquishing your parental rights. At least till such a time that you can prove yourself capable to regain custody. I suppose it depends on why you are giving away the child and who you are giving it to. I know a lady who is raising her grand-daughter. Her daughter just handed her over and they have an agreement. If the daughter changes her mind, I know that the Grandmother has to give the child up.

Probably to the extent that there will be no legal reprocussions however this puts the person accepting the child at risk of your changing your mind at some point in the future and reclaiming a child which has become a loved member of their family..

Some communities have programs where the birth mother can leave the baby at a hospital emergency room or a fire house and not have legal action coming for her.
It was set up to stop babies from being abandoned in an unsafe place by frightened teenage mothers. Check in your community or call your local hospital.

I was trying to find that information out myself. My husband wants custody of his son but doesn't want to go to court. I know you can do a custody agreement and have a notary sign it. But, my mom said she tried to get custody of my cousin and only had to have her mom sign one paper. But, she doesn't remember how and it was a long time ago so things may have changed.

If it is a newborn child, they can leave him or her at a hospital with no questions. Anything else, no it requires legal papers of some sort!
