It would be up to the laws of Kansas and the court system of Kansas to determine what should happen and how it should proceed.
Each particular church, which is a larger construction than a local church, has its own code of canon law. For example, the Ruthenian Metropolia of Pittsburgh has promulgated its own code of canon law. I chose it because it is the United States' only completely self governing Catholic Church. The others are tied to Rome, Antioch, Kerala, Malabar or other places such as the Ukraine. Within each local church, the larger system of canon law is more than a model code like the US model codes used by a state, but less than a universal system of law.
While the American Church has come up with a policy, it is only as useful or binding as the local community makes it.
The policy was sent to Rome for approval, but I don't know what happened. Pending approval each local church is implementing its own policy. Each religious community and each local church is independent. That is part of the reason the problem became so big. The perception of centralized control is a Protestant myth. The Catholic Church is probably the most decentralized organization on Earth. Communication in decentralized groups is naturally terrible, but a group in denial and decentralized is just waiting for disaster.
The leadership relied upon bad advice. In the '80's psychologists really believed pedophilia was treatable. In fact, they believed it was one of the most treatable illnesses they see. What they did not realize was that the treatable population was the portion of the population that voluntarily came in, which up to that time was most of their population. The final problem comes from the early church. The early church felt that any complaint against a member of the clergy or laity was a subject for mercy and protection. So unlike the American system in which the entire world knows what happened, no one knows who isn't directly involved. Predators thrive on silence. The Church just wasn't prepared. Further, bishops are trained to be local pastors. They have never taken an MBA course in their life. No one told them about group think, or vicious circles. They were incompetant managers. They were trained to pray, heal and support broken people.
I believe now there are two routes taken. The first is to put the person under permanent supervision. The second is to defrock them, but in that case, they are simply released into the general population without monitoring. In some cases there is prosecution, but most of these cases are decades old and have past the statutes of limitations.
