Why do 16 years old sex offenders get away with probation.

What if they offend a 3 year child and the 16year olds parents know that he has done this before and never said anything to you. (the 16yr old is my husbands nephew)The 3 yr old is my child

Because they are minors and can't be prosecuted as adults.

Because they are minors and the federal government's eye they can not be tried as an adult. It's like saying "Yeah you raped a little girl but because you're 17 I'm gonna have to let you go with parol. "
Minors can get away with a lot of things. For example, you no minor can be binded to a contract. They can enter and leave freely.

Because they are under age and still considered minors. My solution is castration. Just don't get caught cause you really don't want to end up in jail over a pervert sex offender.

Depending on the state, they can be prosecuted as adults. I work in the juvenile justice system in Texas - we have certified them as adults - we have also given determinate sentences where part of their time is spent in juvenile correctional facility and then they are transferred to the adult system.
