I take it your step-dad did not legally adopt you. If not, and if you are under age, then your mom (if she has full custody) has the final say. If your biological father has partial custody, the fight could get even uglier.

Unless your step-father has legally adopted you, he has no standing to claim custody. Unless there is something about your mom that would cause a judge to rule her an unfit parent, there are not a lot of options.
That being said, if you can get the case into family court you might have a shot. Family court judges have very broad discretion, but you would have to convince them that living with your step-dad would be in your best interest.

talk with your therapist about your concerns because they can help you. also, if you are old enough the judge may ask you who you want to live with. but in this case he may not. since your mom is divorcing your step father. at any rate, ask your therapist if they can either speak with the judge for you or set up a meeting between you and the judge to discuss your issue.

Well, I used to live with my dad every once and a while and I am 12 so it's illegal for me to stop going to his house, but I did, I told my mom I didn't want to keep going to my dad's and so- I just stopped going, so, why not ask your Step-dad if you can stay with him? And if he says yes you have the right to go with him. And if your mom tries taking your step-dad to court ask if you can speak in the trial and tell the courts how you feel and that you want to stay with your step-dad.

It probably depends on how old you are and how suitable your step dad is. Usually I think the courts rule in favor of the Mom.

WHEN YOU GO TO COURT SCREAM OUT AT THE TOP OF UR LUNGS I DONT WANNA LIVE WITH HER OR ASK TO TALK TO THE JUDGE IN PRIVATE AND YES I THINK A THERAPIST MIGHT BE ABLE TO EITHER HELP YOU OR TELL YOU A BETTER WAY THAN US!!!

depends on yr age.in my country all kids below 10 go with the mother, older are asked by the court and kids decide. if yr 18 u don't have to ask. u just move with him.

How old are you? If (in some states) you are 16, you can live where ever you want...and nothing either one of them can do about it.
