It is statutory rape. You are not old enough in the eyes of the law to say yes.
In plain English.
You can say yes it was a mutual agreement to have sex. Your girlfriend will still be guilty of statutory rape. She will be on the national sex offenders list and will have to register with her state (after she served a prison term) whenever she moves.

as long as you dont go around blabing to every tom di ck and harry then your fine, there is no problem with you to going at it, there are laws about that but 99 percent of the time it will only bite you if the guy is older, because our frigged up society says that men are the ones who do the raping so i dont think anyone is really going to care that she is older,
the biggest factor to consider is both of you twos parents cause i think that they would be the most likely to make trouble for either one of you, good luck and happy hunting

does your question mean "can we have sex or can we enjoy sex". you can definately enjoy sex since both of you have reached puberty but legally you are not allowed to have sex, but your girlfriend is.
so wait for two more years and then legally enjoy it.
