the felony was commited 50 yrs. ago, did not involve violence, or weapons, time was served, parole satisfied, my wife is canadian, we visit relatives there and after the first of the year i am going to need a passport..any advice for me???

A felony conviction (once the convict is released from prison) is no bar to having a passport. Just apply and get it. No lawyer necessary. http://travel.state.gov/passport/passport_1738.html

It's not even a question on the application.

To visit Canada, a US birth certificate and photo ID are enough. http://gocanada.about.com/od/canadatraveloverview/qt/uscitizenborder.htm "Americans do not a passport to visit Canada. However, the Western Hemisphere Travel Initiative (WHTI) will require American citizens to present a passport to cross the Canadian border beginning January 1, 2008."

Your question isn't quite clear, though. For permanent residence in Canada -- and not just a visit -- a passport is needed and the Canadians, but not the US Department of State, will inquire about convictions.

Your passport may be revoked, restricted, or limited for the same reasons your passport application can be denied. These reasons include:

You have an outstanding felony arrest warrant.
A court order forbids you from leaving the United States.

You are entitled to administrative review and judicial review. Within 60 days of receiving written notice, you can request an administrative hearing. The hearing will allow you to testify, present evidence and witnesses, and make arguments. The hearing officer will make factual determinations and submit recommendations to the Deputy Assistant Secretary of Passport Services who will make a final determination. If you are not satisfied with the decision, you may appeal to a federal district court.

why are you so worried just go and apply you will get it i know someone with amore resent conviction for armed robbery and the State dept issued her a passport
