To be honest, it really depends on the location. Sentencing guidelines vary greatly from region to region. However, since it is a first offense, there is a possibilty of a lighter sentence such as rehab/probation.

I don't have enough details like why didn't they dispose of all the cases at the same time or did the offenses occur at different times. If he has additional charges then he will probably serve some time. He has some serious charges, I hate to be the bearer of bad news but 1 month in prison is not going to be payment enough. They have mandatory sentencing and wouldn't be wasting time with conspiracy if they weren't planning to put him away for a long time.You said possession with intent, 1 gram or more, and a conspiracy. Are you sure he wasn't in jail and given and given house arrest, or an "OR" bond, while he awaits trial? He needs a good attorney dude, or he is toast. Minimum 5 but probably a 15-20yrs.

My husband who has served 10.5 years in Texas State Prison says he will get probation on 1 count of possession. As long as everything happened at the same time (all charges are from one incident). The count of delivery was probably because he had more than one bag of cocaine.

You need to change your circle of friends. He can go back to prison, I don't know what the odds are though or for how long. But that is always a possibility.

Lots of times it depends on what state u r in. But from family experience if he claims personal use and asks for rehab he could skate

Hilarious--the bozos here are discussing sentencing and putting him away for life and he HASN'T EVEN BEEN CONVICTED YET. Wake up call for you drones--you have to be convicted before you are considered guilty, and that's when sentencing occurs.
