I went on to sign the lease agreement.
I walked out onto the lot only to find my new car with a big crack on the passenger side of the windshield. The cause was an accedent during prepartion for me to take it home. They gave me another car to use while they replace the windshield. Since they are replacing the winshield in the dealership not the factory, Does this affect the value of the car? what are my rights?

Some people are saying I am just leasing it, however

1.) At the end of the lease I have return the car back and they will appraise the car. I will pay for any extra wear and tear on it.

2.) I have an option to buy the car should I not want to return it after 3 yrs.

I would not like to pay for something damaged before it has ever being driven.

Windshield replacement is not a problem, and will not effect the value of a vehicle at all!!! I would say that at least half the vehicles on the road in major urban areas have either had a windshield replaced, or have cracked windshields that need replacing. Windshields are broken regularly, by stones and debris that are thrown up in traffic!

If the only thing damaged was the glass, I would not worry about it.

Fixing the widow here or there does not affect the value of the car. When you sign the papers and drive the vehicle off the lot, that lowers the value of your car. Your rights are only that they replace the windshield for free. Or maybe you can get a new vehicle of your choice.

You have no rights. It is not even your car. It is a LEASE! It belongs to them... You are just paying a Stupid amount of money to have the privelage of driving the most expensive miles you possible can have on a vehicle. What you should have done was just paid cash for a good warrantied 3 year old car coming off a lease for about Half price of a new one. That would have been smart...

Its their car. The window being replaced will not affect its value in any way. Besides... even if it did... its NOT YOUR CAR! you are just paying the depreciation of the miles you will put on it.

THE DEALER DOES NOT OWN THE CAR, AS YOU BELIEVE. THE CAR BELONGS TO THE BANK THAT BOUGHT THE CAR FROM THE DEALER TO LEASE THE CAR TO HIM!!!!!!!!!

WHETHER SOMEONE BUYS OR LEASES THE CAR, DEALERS DONT CARE BECAUSE THEY GET THE FULL COST OF THE CAR UPFRONT FROM THE LENDER!!!!!!!!!

If it were I doing this, I would not accept delivery on the vehicle. Have them prep another one for you. Make sure you verify the VIN plate before you accept the replacement vehicle.

If they refuse and point to your signed contract, have them show you in the contract where they can damage the car and still make you take delivery. You signed the contract with the understanding that you bought a vehicle with no damage.

That it was in an accident will affect its resale value. As far as your rights, you will have to contact a lawyer. In my personal (not legal) opinion, you should be able to get a replacement vehicle, but a lawyer will be able to tell you for sure.
