They have a visa giving them permission to go 50 miles out of Mexico, and they are in Kansas, and we all know Kansas is way way more then 50 miles. Does that itself make them illegal?? And can they be deported back to Mexico if caught??

You are referring to "border crossing cards" which allow individuals who frequently travel into and out of the U.S. to enter the country for up to three days at a time, and they allow travel of up to 50 miles from the border.

In general, persons who receive those cards are middle class professionals and others with a legitimate need to cross the border regularly. Most could probably obtain ordinary B-1/B-2 visas allowing travel further inland.

Where is the interest of the US in revoking an incidental breach of the limit? Would that cause Mexico to reciprocate (Mexico allows US citizens to visit its border area without a tourist card.)

Are you sure the Mexican in question doesn't have a combination BCC & B-1/B-2 visa? The only difference in using the BCC instead of the visa is saving the $6 border crossing tax.

Don't know much about a '50 mile visa', but it would stand to reason that if it says 50 miles, and you're in Maine, something's wrong. I really wish that Congress would get this one down on paper and we can start seeing the law being enforced etc...

Yes, and yes. Anytime the terms of a visa are violated, that is being in the country illegally.
