A bankruptcy should drop off of your credit report 10 years after your discharge. If it is not off by Jan 2007, I'd be contacting the 3 bureaus and have it removed. It's a full 10 years no matter WHERE you live .. since BK is Federal and not State. The "7 year" rule is the length of time before you can legally file BK again if you had to. To that end, if you file a Chapter13, it doesn't discharge until you are through with your payment plan, which is typically 5 years. Meaning that someone who filed a Chapter 13 would have to wait 15 years before they see the bad mark vanish.
Chapter 13's are typically filed where a majority of the debts are from SECURED type loans (ie: house, cars etc). Chapter 7's are when a majority of the debts are unsecured (credit cards, primarily). Hope that helps.

Why can't you people spend just a couple minutes researching your answers? Only took me 3 minutes!
According to the Fair Credit Reporting Act, bankruptcies must be removed after 10 years, from the date of the filing.

I was told that it stays on for 10 years.......and it will drop off supposely the Month that it was discharged. I filed in August of 1996 and it was discharged in December of 1996. I am in the process of writing letters to all of the Credit Bureaus now to find out what I have to do get this accomplished,,,,,,,It has been a long 10 yrs.....I thank God and I am looking forward to be having it over with........God Luck and God Bless you.....

I'am sorry to tell you this but a bankruptcy,eather a chapter (7) (11) or (13) stayes on your credit report for a long-long 10 years. I know, I filed a chapter (13) and I am going through hell trying to ree astablish my credit back. But I did not have any choice at the time.I wish you all the luck in your indever.

The bankruptcy should be off your record this year. Check your states bankruptcy laws. If it's been 10 years since it was discharged, and the credit reporting agencies are still reporting it, call and request the proper docs. to remove it.

Until this November. In December get copies of you credit reports to make sure it came off. If not, notify the reporting agency that those ten years of credit hell are OVER!

they say it last from 7 to 10 years but I think you may be able to contact the credit bureau and dispute the matter and it may come off sooner than that. Also you should be able to start trying to apply for credit just after it discharges.
