Stepmother and sister involved, SM states that children owed nothing and newspaper states that it is a family owned business. Business of substantial size and would like to know right to claim as eldest child of deceased parent. No will is known of or insurance policy. Issue not discussed, not a good situation with step family.Brother was involved with the business shortly before father passed and SM fired him when father became unknowing to situation any longer

I see an sbc.global by your handle, so I figure your in the US if not in California. Laws vary state by state, and the situation looks like a mess. Answer: I agree with other answers,GET AN ESTATE LAYWER.

You have now entered the twilight zone of probate, hassles and legal misery. Get a pro to handle it, or it's sounds like you and the siblings will get ripped-offed.

And make sure you get a living trust going for yourself and your siblings while you're at it.

That depends on where you are. If your living in a community property state, your probably out of luck, as the step-mother inherited everything. Other wise, sense there is no will, it will have to go through probate. It will be up to the probate judge to decide how the estate will be divided up.

Been in the same situation...."step-mommy" got 50 %, the 3 of us kids split the other 50%. AND, they were even separated at the time. Hope it goes better for you. Step sister has NO claim.

The laws are funny in those situtions your best bet is to consult a lawyer most won't charge just for a consultation..Personally I would say you are entitled to part of it but each state varies in laws..so please ask a lawyer and get the right advice..Not guesses..Good Luck..

i say get a lwayer to look into it all states have different laws in my state it would be that she holds half of the airship and the other half would be divide between the children as long as there was no will

Wills are so important.

Only a lawyer can help you beyond what I just said.

Okay I'm sorry for your loss.It all depends if he has a will or not.If he doesn't have a will it will go to his wife.If no wife then it will be split up between children.
