Can I apply for a fiancee visa the second time( different man), if my papers were aproved 5 years ago, but I didn't go to the Embassy to get this visa and didn't go to the USA. The man with whom I was engaged and who applied all papers for a fiancee visa, turned out to be unfaithful. He met another woman in his country and wrote me that we couldn't be together due to these circumctances. My papers were approved, but I couldn't connect my life with him and I didn't go to the USA. 2 years ago I met a very decent person, who loves me and I love him too. We spent 3 months together and he came to me2 times and I visited him too in the USA. Can we apply for a fiancee visa ?

There is no law against double-dipping into the fiance pool!

Your new American fiance is welcome to petition for you, you are welcome to apply for the visa, and you are more than welcome to go to the US, marry him, get a green card and live happily ever after. Since the first relationship didn't work out and you never went to the US, you have violated no law.

In fact, we consular officers look very kindly on people who had every opportunity to go to the US but didn't; that makes you look like an honest person, and subsequent applications look far more genuine.

And congratulations on finding a good guy.

I would agree that you need a lawyer to help you out. With a visa approval in the past, the concern may be shifted from it never being filed to this new application being a 'sham'. You've spent 3 months together..... is that how long you've known him? They may frown on it if it's such a short courtship and require a long wait period to reapply. Do you have the letter from your old fiance proving infidelity? It would help. It may be an uphill struggle, but cross your i's and dot your t's (jk) and you should be fine. Get a lawyer as they can help you with any objections the government have for a second time fiancee........ And Congratulations!

Since you already applied once, I suggest you hiring a lawyer in US to help you with the process. Good luck.
