Depending on the state you live in, there is a law known as open enrollment. This just means that students can attend any public school in the state.

Transferring is just a question of you the guardian/parent withdrawing the student from one school and enrolling in them in a different school. Some schools act like jerks since student enrollment effects their money. Don't let them, you have a right as parent/guardian to withdraw the child with their transcripts. The only loop hole is that the school will not give transcripts if the student owes money or fees of some sort.

She needs to consult and attorney. It seems that they are retaliating against her. Find a different school - transfer school or transfer out of the district would be even better because this will follow her(you might need legal help for that). While she is waiting tell the 8 yr old to keep a diary everyday of things that go on in school just how she feels and things that happen let her write it her own way. Then notify the school district that their child is being unfairly singled out find out what there policy is on bulling and intimidation because that is exactly what it is if she does not find remedy there sue for change -they hate being sued especially for bullying they should no by now what bullying causes (Columbine). And I will tell you this will be difficult because administration in most cases will stick up for teachers I know I am one. That is why she should keep a note book of all the things that go on, because when they get sued you will need a item like that to find out what happens in school everyday with her permission you can she can use some of her pages in her book she shouldn't write things that are very personal that she doesn't want to share and always keep a copy of the book Good luck

This depends on what state/county/school district you are in. I would start by calling the school districts main office and asking them. Obviously there are many private schools you can put your child in, but those can get expensive. There will probably be other schools your child can transfer to- make sure to find out how they are supposed to get there and home again.
