Are the cops allowed to weigh marijuana with the bags and charge someone with that amount....or do the have to charge them with just the amount of the marijuan with out the bag included? If the weigh with the bag....can that be dismissed for tamering or some other reason? Thanks

Actually they weigh with the baggie for evidence then send it to the evidence room where the techs separate out the stems/seeds and other "trash" and weigh only the part that contains THC and that is the "weight" that youre charged with...

They should definitely NOT be allowed to include the weight of the bag. However, my guess is that if it was just over a legal limit (an ounce, for example), to where it is a misdemeanor or a felony, your defense attorney would want to make that point. A judge who allowed the weight of the bag to throw you over that line would be committing reversible error, in my opinion. I doubt that a judge would do that, however.

When I was young and stupid and was buying in that market, I was caught with what I believed to be an ounce. I sweated it out, but it mysteriously shrunk to well under an ounce by the time I got to court, and I never did ask anyone where the extra went. Laboratory testing, I suppose. Testing or tasting or something.

the initial weighing will be in bags, plus they can also merely deduct the weight of the bags. Like they do on the semi trucks to know the weight of the load.

but in general after they figure the @ wieght, they will do an intial charge, but before the actual trial starts, what they do is sent the drugs to the crime lab for an official test to prove it is the illegal drugs and to get the official weight

From the time you are charged, they have merely the basic facts, and the evidence grows as they investigate

Yes, they weigh marijuana and other drugs in the packaging. It adds only an incidental amount of weight. I'm not understanding how the police weighing it in the bag would come anywhere close to being tampering. Sounds like you were caught with drugs and you're trying to get out of it. Try owning up to what you did instead.

Ha ha! That's a good one!

It should include the weight of the container. That way when they spill it during "sampling" the charge can include the weight of the police car.
