Hi My ex-husband is ordered by court to pay child support every month and he has stopped. Im going to go through the state and everything. But I was just wondering does my child still have to go for visitation if he isn't paying child support?

Child support and visitation are two different issues so the father is still entitled to see his kid regardless of how he is making his payments.. I don't know the circumstances but you should contact the child support office and advise them the payments have stopped perhaps there is a problem with the checks or payment center (problems do occur at the child support and payment centers) if that's not the case then request for a a follow up (delinquency letters or a simple phone call) if that all fails then the case will be submitted for court enforcement.

Hun unfortunately the answer is yes, funny how they can enforce one law of visitation and not another. Im not a volient woman but Perhaps beating all the ex spouses in this world to realise they are depriving there children not there ex from things by not paying child support might help. Good luck I hope things change for you.

I agree totally with some comments here. Child support and access are two separate issues.

I have to ask, is equal parenting an option here? In not, why?

Also, before I was the custodial parent, I was ordered to pay $2,000.00 per month in child/spousal support when I was earning $2,250.00 per month. Now I have custodial and I can't get a cent.

Sometimes deadbeat parents don't just happen; they are made by the system.

Yes. It's a court ordered visitation, not made by you / ex but by a judge. You go against this and you can possibly lose custody.

yes if it is ordered by the court if the child is old enough to say they dont want to go. u cant keep a child from parent because of money go back to court

I've been going through the same situation and the courts told me that he does but call or go to your nearest enemployment office their is a book of rules and guidlines free in tthe office just ask an employee there for help if not let me know ive got it and i know how your feeling.

Yes. Just because he's not paying, doesn't mean you can also violate the agreement by stopping visitation.

This was explained to me in detail when my papers were drawn up for my eldest child.

If you violate the agreement also, then you are both in the wrong and that does not look good in front of a judge.

Yes, unless the judge who signed the custody papers changes the visitation ruling. My advice is to contact your lawyer and tell him/her about it.
