I got a DWI in December of 2005. It was a life changing mistake that taught me an important lesson. Now I am on probation for the next two years and let me tell you, it is not fun at all. There are strict guidelines that I must follow and I'm already working hard to get them out of the way (as soon as possible). What I was wondering...and really, this question only applies to those who have experienced a DWI in the state of Texas...Will I be able to leave the U.S. if I want to take a trip overseas? I'm talking about a week in Russia sometime next summer (my mother wants me to go with her). I think it would be fun because I have never seen that part of Europe before.

The only way this would be an issue is that if you are specifically prohibited from leaving the country. For a DWI, I seriously doubt that this would be prohibited. I see no reason why you should not be able to go overseas. I would check with your PO if you have one to be sure.

In most states if you are on probation you must abide by certain conditions. These restrictions definitely include where you must be. Violation of this even includes not informing the court if you moved. According to Arizona Revised Statutes, Chapter 13:

"2. Place restrictions on the person's travel, associates or place of abode during the period of release."

If you want to take a temporary trip you need to contact the court and request a motion to modify probation. This needs to be approved by the judge.

If you are looking for a long term move you then need to pursue the procedure in your jurisdiction for filing for an "Interstate Compact" allowing you to complete your probation in another state.

If, however, you do leave the state (or county sometimes) and you are arrested for anything at all you will be violating your probation and thereafter be considered a Fugitive of Justice. Most courts allow for change and it's in your best interests to just do it the right way. Good luck.

I don't see any problems with you leaving the country. A DWI is a misdemeanor offense which wouldn't stop you from traveling. If you have paid the fine and completed the terms of you sentence community service, and reporting you shouldn't have a problem. You might want to check with your probation officer if you have supervision and need to report during the time you will be out of the country, to be on the safe side. Good Luck! And Enjoy Your Trip!

Yes you can travel. You simply need to make certain that your probation officer is aware of and has agreed to your travel, and signed off on the proper documents.

generally probation officers will approve travel after you fill out a travel permit form and they ask you to keep a copy of it on you at all times. the form will ask the dates of your travel, where you will be going, where you will be staying and the method of travel.......its a formality in case you were to get into any legal troubles while out of their jurisdiction

I don't think your allowed to leave the state muhc less the country.
