I really do not understand your question!
Perhaps you are asking: if my drink was spiked with alcohol and I did not know, and then drove and got arrested for drink driving, would I have a defence?
If that is what you are asking, then you may well have a defence - your friend who bought you the drink would need to make a statement - and would hopefully say that he put vodka in it without you knowing - but you seem to say that you did know what had happened some 5 minutes later - so in that case you would not have had a defence.
Hope my answer is slightly less confusing than your question!

Give it a try, but honestly, the police and the judge have heard this one about fifty times a week for the last twenty years. You may actually anger them more than anything, and get a stiffer penalty than a simple "guilty" verdict would get you.
Can you have your 'mate' appear in court, and attest that they provided you with that drink, that it is all their fault? And if the judge thinks the pair of you are trying to pull a fast one, you may find a summary contempt ruling against your mate. A fine, a week in jail, it's possible, it has happened before. How many lifestyle witnesses can you bring to court, to SWEAR that you NEVER drink alcohol, not at christmas, not wine with a meal, not champagne at weddings, not in cooking, that you have a hatred and loathing of alcohol, and want it banned?

If it was laced with vodka, and you didn't realise at the time, then you either have no taste buds or a very, very small amount of vodka was put in. More likely is that someone is winding you up.

either the vodka quantity was so minute it would not matter or your an idiot. i dont drink, but i can still sure as hell tell the difference between an orange juice and one with more than an atom of vodka in it.

LOL laced isnt the word when you're talking about a drink. The word for when a drink has been tampered with is Spiked. Lace is when someone messes with your herion or some **** lol.
