After last call, an officer noticed a man leaving the bar so drunk that he could barely walk. The man stumbled around the parking lot and trying his keys on five different vehicles, the man managed to find his car. He sat there for a few minutes, as a number of other patrons left the bar and drove off. Finally he started the car. He flicked the blinkers on, then off a couple of times, honked the horn and switched on the lights. At last, the parking lot empty, he pulled out of the parking lot and started to drive slowly down the road. The police officer now started up the patrol car, put on the lights and pulled the man over and preformed a breath test. To his amazement, the breathalyzer indicated no evidence of the man having consumed any alcohol at all! The officer said, "I'll have to ask you to accompany me to the police station. This breathalyzer equipment must be broken." "I doubt it," said the drunkard. "Tonight I'm the designated decoy."
Could you be charged for this?

It would be a long shot but you could definitely be charged especially if one of your fellow drinkers went down the road and killed himself or someone else. It is the same as holding the bartender liable for serving the alcohol if I can prove you had knowledge and aided in the person's getting on the road which led to the death or injury. And you would be guilty!

I take issue with the police officer since you need more probable cause then just what the joke describes. Which means you would have to commit a traffic violation of some sort which includes improper lane usuage so if you think weaving back and forth is not a citeable offense, think again.

Actually, a case might be made for criminal conspiracy if the officer could show that the person knew a crime was being committed and willingly abeted the act. It would be slim at best. However, as a police officer, there would be hell to pay if I found out this was going on. Each year, drunk drivers kill more people in this country than all weapons related crimes combined.

What law did he break? Cops lie in wait all the time after closing time at the bars.

I don't see for what, unless you live in one of those towns that has all those little "annoying" laws such as too many air fresheners hanging from the mirror
