My husband and I have been married for a year and my daughter still has my maiden name for her last name. Her father is somewhat involved and I am glad she knows her father but I want her to have the same last name as me. I worry she'll be made fun of when she goes into school with a different name than her parents. What I would like to know is can I change her last name without my husband having to adopt her, I know her father will not sign away parental rights and I wouldn't want him to stop being involved.

Guess I wasn't clear enough. I was not married to her father which is why I still had my maiden name. Her bio. father is not paying $$, I don't need it, doing fine without it. He is only involved out of a sense of obligation... and I have talked to him about signing away parental rights before and he says it's not natural. He has seen her maybe 2 or 3 times since her birth but now wants to be involved more. My husband and I have been together since she was 1 and calls my husband daddy, she is 4yrs old so not really of age to know anything except she doesn't have mommy and daddy's name. And she wants to have it.

Yeah you can there is these papers you have to file and pay some cash and you will be able to do it...even if he is not the father....my last name is by my father the one who raised m,e and he is not my sperm donor....I wish I had the number to give you if I can find it I will hit you back up with it okay....good luck.....

That a tough question I was raised by my aunt and uncle since I was 2 days old and when I started school I insisted on having the same last name as who I felt where my Mom and Dad I did not get legally adopted till I was grown My real name was on my drivers license when I turned 16 but I used my parents name for everything else.

Yes it's a simple procedure for a name change. But it isn't really uncommon now days for children to have a different name than the remarried mother. Actually it's almost more difficult to find someone that hasn't been divorced/remarried! Your child will be fine and a name change might actually cause a strain with the bio-father causing more stress on your daughter than any classroom trauma.

if the real father on the birth certificate if he is Ur husband cant adopt her at all with out the father signing his rights over i know i have the same problem but my husband is on my daughters birth certificate if he wasnt on there her real dad would have to give his rights up

In Indiana you must have the biological dad's OK for this.
If he's not OK w/adoption, then he'll probably not be OK this, either. Can't blame him, esp. since you're wanting him to still be involved in her life (translation: paying $$??).
Trust me, hon, I'd bet that over 50% of the kids in Indiana don't have the same name as their other siblings, let alone the mom.
Why you keep your maiden name when married her dad?

I doubt it. Most likely if your daughter had a choice about it she'd want to keep her last name. There's nothing wrong with that. My daughter has a different last name than I do but no one thinks anything of it as far as I know.

all i know is that he has to adopt her, but to be sure ask a lawyer that question they will be able to help you out more then what i could.
