I have a friend of mine who was stopped for speeding in a small hick town in North Carolina a few weeks ago. Without asking her for her license and registration, The police officer gives her a ticket. Is this illegal and can she fight the ticket?

If he didn't see her license, how did he know who he was issuing the ticket to?

Some cities have automated cameras that snap photos of speeding cars - if the photo clearly shows both the license plate AND the driver, this has been deemed legal identification to issue a ticket.

She can fight it in court - but she will loose. A person must present there drivers license and auto registration upon request but the police officer is not required to request it before issuing the ticket - even though it is typical standard policy.

I guess that cop is a psychic and a good one at that. If he did not see her name, address and proof of registration to see who owned the car how was he able to write a ticket?. A blank ticket? Unless he actually did a check on the tag and the car was actually registered in her name or she verbally gave him the information and she actually answered honestly, I see no way he could have known the necessary info to fill out a citation. Anyways, have her check with a lawyer first. Lawyers know best.

Yes, he can write a citation for speeding. Once he had your friends name and date of birth he looked up her driver's license data in a state computer.

I don't think your friend would have been enamored of the alternative; nearly every state has a process called "Instanter" which means if you don't have your driver's license with you the officer can take you "instantly" before a judge to assess a fine or a bond....Or she could have been incarcerated until she posted bond.

No, but good luck fighting it in a backwater town. There is a difference between justice & reality. Pay the ticket & be glad they didn't lock you up. And then, stay away from there, which is what they probably wanted in the first place.

they had the plate number that's all he needed she was lucky last time i was thru N.C the cop took my license and had me follow him to town and face the judge to get my fine and pay it before i could leave.
