my boyfriend and this dude got into a fight and my b/f beat the guy up. (he was defending me b/c this guy was trying to hit me). Now my boyfriend's getting charged with 2nd degree assault. He's 16 so he's being charged as a minor. Does anyone know what the punishment would could be if it was his first offence, ever? I'm really scared b/c his court date is september 12!!!

Well, he will likely get 6 months to 2 years probation with community service and fines. However, get a public defender NOW. He can request one at his FIRST hearing. He must file (or his parents can file for him, as an indigent). He is charged with second degree assault because they cannot prove "intent". He may be able to beat the charge, depending on the statute in the state you live in. He needs to speak to the public defender AND SO DO YOU!!! Anyone who was a witness to what happened NEEDS TO DO SO. Also, I suggest that YOU file a police report about the incident.

There is a difference between being charged and convicted. At his age, without a prior criminal record, there is a good chance he could get off the hook. After all he can argue that he was trying to defend you at the time, which is a reasonable story. He'd have to get VERY unlucky to get into much trouble here.

Make sure he dresses nice for court. Shirt, tie, pants, NO JEANS, NO TEE.

They will prolly give you a deferred if it's your first. Stay clean until then and after-keep away from the people and make some new friends.

Tell him to run. Live in caves, ditches and under bridges. Live off the land. In 7 years he'll be expunged of the crime.

he can plead out to probation for 6 mo. most of the time GOOD for him

probably probation sence its his first time hes got into trouble
